Terms of Service

Please read these Terms carefully. By submitting an inquiry, entering into a placement agreement, or using any service provided by Gold Mine ATM's, you agree to be bound by these Terms of Service. If you do not agree, do not proceed with our services.

1. Parties and Agreement

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Business Owner," "Client," or "you") and SUO Visions LLC, a Pennsylvania limited liability company operating under the trade name Gold Mine ATM's ("Gold Mine ATM's," "we," "us," or "our").

By submitting an inquiry form, engaging in service discussions, or entering into a placement agreement with Gold Mine ATM's, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Description of Services

Gold Mine ATM's provides the following services to qualifying businesses:

ATM Placement Services

  • Sourcing, programming, and delivering ATM equipment to approved business locations
  • Installation and setup of ATM equipment at no cost to the business owner
  • Ongoing maintenance and technical support for placed equipment
  • Optional custom ATM wraps and business branding on the ATM screen
  • Receipt coupon advertising options

Vending Machine Placement Services

Vending machine placement services are currently in development and will be offered to qualifying locations upon availability. Submitting interest does not guarantee placement or a specific timeline.

Important: All Gold Mine ATM's placement services are provided at zero equipment cost and zero maintenance cost to the business owner. Gold Mine ATM's retains ownership of all placed equipment at all times.

3. Communications and Messaging Terms

A2P 10DLC SMS Messaging

Gold Mine ATM's sends business text messages via registered A2P 10DLC (Application-to-Person 10-Digit Long Code) messaging in compliance with The Campaign Registry (TCR), CTIA guidelines, and applicable federal and state law including the Telephone Consumer Protection Act (TCPA).

By providing your phone number and checking the SMS consent box on our contact form, you provide express written consent to receive autodialed or pre-recorded text messages from Gold Mine ATM's at the number provided. Consent is not a condition of purchase or service.

Standard SMS Disclosure: Message frequency varies. Message & data rates may apply. Reply STOP to opt out. Reply HELP for help. For support contact [email protected].

  • You may revoke SMS consent at any time by replying STOP to any message
  • To re-opt in after opting out, reply START
  • Opting out of SMS does not affect your ability to receive services from Gold Mine ATM's
  • We do not share SMS opt-in data with third parties for their own marketing purposes
  • Messages may include service updates, appointment scheduling, installation coordination, and business communications

Email Marketing

If you consent to receive marketing emails, Gold Mine ATM's will send promotional and informational emails in compliance with the CAN-SPAM Act. Every marketing email will include a functioning unsubscribe link. You may unsubscribe at any time and we will process your request within 10 business days. Unsubscribing from marketing emails does not affect transactional service communications.

Calendar Invites and Scheduling

Gold Mine ATM's may send calendar invitations to the email address you provide for the purpose of scheduling site assessments, installations, and service appointments. These are transactional communications tied to your service agreement. You may decline any calendar invitation without affecting your services.

Analytics and Tracking

Gold Mine ATM's does not currently use website analytics or third-party tracking pixels. If analytics tools are implemented in the future, we will update our Privacy Policy accordingly and provide notice to users before activation. Use of our website after such updates constitutes acceptance of the updated policy.

TCPA Compliance

All telephone and SMS communications from Gold Mine ATM's comply with the Telephone Consumer Protection Act (TCPA). We will not contact you via automated telephone systems or pre-recorded messages without your prior express written consent. You may revoke consent at any time by contacting us directly or by replying STOP to any text message.

To be eligible for Gold Mine ATM's placement services, you must:

  • Be a legally operating business entity or sole proprietor in good standing
  • Be 18 years of age or older and authorized to enter into binding agreements on behalf of your business
  • Operate a physical business location suitable for ATM or vending placement
  • Have adequate foot traffic and space requirements as determined by Gold Mine ATM's during site assessment
  • Comply with all applicable local, state, and federal laws related to ATM or vending operations on your premises

Gold Mine ATM's reserves the right to decline any placement request at its sole discretion without obligation to provide a reason.

5. No Guarantee of Placement

Submitting an inquiry form or engaging in discussions with Gold Mine ATM's does not constitute a guarantee of service, placement, or any contractual obligation until a separate written placement agreement has been executed by both parties. All placements are subject to site assessment, approval, and equipment availability.

6. Responsibilities of Gold Mine ATM's

Upon execution of a placement agreement, Gold Mine ATM's agrees to:

  • Provide, install, and maintain all placed equipment at no cost to the business owner
  • Respond to equipment service requests in a timely and professional manner
  • Ensure all equipment is operational, compliant with applicable regulations, and properly networked
  • Handle all back-end operations including cash management (where applicable) and technical servicing
  • Conduct all operations professionally and with integrity

7. Responsibilities of the Business Owner

As a business owner entering into a placement agreement with Gold Mine ATM's, you agree to:

  • Provide a safe, accessible, and suitable location for the equipment as agreed upon
  • Not tamper with, relocate, or service the equipment without prior written authorization
  • Notify Gold Mine ATM's promptly of any damage, vandalism, theft, or equipment issues
  • Comply with all applicable local, state, and federal laws regarding ATM or vending operations on your premises
  • Not obstruct or interfere with Gold Mine ATM's access for maintenance and servicing
  • Provide reasonable access during agreed-upon service hours

8. Equipment Ownership

All ATMs, vending machines, and associated equipment placed by Gold Mine ATM's remain the sole property of SUO Visions LLC at all times. The business owner is granted a non-exclusive license to have the equipment on their premises in accordance with the placement agreement. No ownership rights in the equipment are transferred to the business owner under any circumstances.

9. Limitation of Liability

To the fullest extent permitted by applicable law, SUO Visions LLC and Gold Mine ATM's shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of revenue, profits, or business opportunities arising from equipment downtime
  • Damage to your premises resulting from normal installation or maintenance activities beyond what is covered under a separate placement agreement
  • Any third-party claims arising from the presence of Gold Mine ATM's equipment on your premises
  • Losses resulting from circumstances beyond our reasonable control including but not limited to natural disasters, power outages, internet service failures, or acts of third parties

In no event shall our total liability to you exceed the total value of services rendered under the applicable placement agreement during the three (3) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless SUO Visions LLC, Gold Mine ATM's, and their respective officers, members, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or in connection with:

  • Your breach of these Terms or any placement agreement
  • Your negligence or willful misconduct
  • Any unauthorized tampering with or misuse of placed equipment
  • Any violation of applicable law by you or your business

11. Intellectual Property

All content on the Gold Mine ATM's website, including text, graphics, logos, and design elements, is the property of SUO Visions LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any content from this site without prior written permission.

The Gold Mine ATM's trade name, logo, and associated branding are owned by SUO Visions LLC. Nothing in these Terms grants you any license or right to use our intellectual property.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or any placement agreement shall first be subject to good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, it shall be submitted to binding arbitration in Pennsylvania under the rules of the American Arbitration Association, unless both parties agree otherwise in writing.

Nothing in this section shall prevent either party from seeking emergency injunctive or equitable relief from a court of competent jurisdiction.

13. Termination

Either party may terminate a placement agreement in accordance with the termination provisions set forth in that agreement. Upon termination, Gold Mine ATM's reserves the right to retrieve all equipment within a reasonable timeframe. The business owner shall provide access for equipment removal and shall not obstruct retrieval.

Gold Mine ATM's reserves the right to immediately terminate services and retrieve equipment in the event of a material breach of these Terms or a placement agreement by the business owner.

14. Modifications to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting to this page with an updated "Last Updated" date. Your continued engagement with our services after any modification constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it enforceable.

16. Entire Agreement

These Terms, together with any executed placement agreement between the parties, constitute the entire agreement between you and Gold Mine ATM's with respect to the subject matter herein and supersede all prior or contemporaneous communications, representations, or agreements, whether written or oral.
